1) Quotes & Pricing

1.1 Automated Instant Quotes (Instant Car Shipping Cost Calculator)

NX, LLC (“NX”) provides automated instant quotes through its Instant Car Shipping Cost Calculator as a convenience tool for customers. These quotes are generated using median examples of standard vehicle types, including cars, trucks, SUVs, pickup trucks, and vans.

  • Vehicle Type Limitations – Automated quotes are based on standard vehicle categories only. Oversized, high-roof, extended, lifted, lowered, commercial, modified, or otherwise atypical vehicles may require adjusted pricing. NX reserves the right to revise any automated quote, including those booked as an order without prior human verification, if the details provided do not accurately reflect the vehicle’s specifications, condition, or configuration.
  • Manual Review & Price Lock Guarantee – As part of NX’s Price Lock Guarantee, every order booked online through the Instant Car Shipping Cost Calculator is manually reviewed to confirm accuracy. If the automated rate requires modification, NX will notify the customer before dispatch for approval of the revised pricing.
  • Disclaimer of Liability – NX is not liable for inaccuracies, omissions, or errors resulting from the use of automated software. Automated quotes may not account for market volatility, fuel surcharges, seasonal demand, or other cost variables outside NX’s control. Final pricing is confirmed only at the time of order review with customer approval.

1.2 Transparent Pricing, Quotes & Deposits

  • All-in Quotes – Quotes include known fees; there are no hidden charges.
  • Booking – Free. No deposit is charged until Dispatch/Assignment, except port/vessel reservations (e.g., HI/AK/PR) where the deposit is charged at booking to reserve space and is deemed a Dispatch.
  • Price Lock Guaranteed Rate Protection (to the deposit amount) – NX, LLC will maintain the booked total price by reducing its service fee (down to $0 if needed) up to the deposit amount to preserve the quoted rate. If any third party requests additional fees, Customer must contact NX, LLC immediately.

 


2) Parties and Definitions

  • Customer: Any party listed in the shipping or billing sections of the order, including the cardholder.
  • Dealer: Any Customer who is a dealership or acts on behalf of one (owner, manager, sales associate, etc.).
  • Carrier: The motor carrier assigned by NX, LLC to transport the vehicle(s).
  • <p">Dispatch/Assignment: The moment a vehicle is assigned to a Carrier; for offshore shipments, issuance of a vessel booking number is deemed a Dispatch.

3) Payments & Accepted Methods

  • Balance at Delivery: Unless otherwise stated, the remaining balance is due to the Carrier at delivery in certified funds (cash, Zelle, cashier’s check, or money order).
  • Port/Offshore Timing: For port shipments, carrier funds may be required at pickup; NX, LLC will provide instructions before the Carrier arrives.
  • Full Credit Card Option (upon request):
    • For full-fee charges of $200–$600: $75 convenience fee
    • For full-fee charges of $601+: $150 convenience fee
  • Operational Note: Some transports (typically, but not exclusively, trips ≲500 miles) may be charged in full at Dispatch or require up to 50% of the deposit at Dispatch based on circumstances.

4) Communications & Opt-Out

By submitting an order, Customer consents to be contacted by phone, email, and SMS (carrier message rates may apply). To opt out of promotional or status messaging, reply “UNSUBSCRIBE.” Opting out of both email and SMS may prevent delivery of important order updates.


5) Scheduling, Availability Window & Delays

  • First Available Date: Pickup efforts may begin on Customer’s first available date. Customer agrees to allow up to 10 calendar days from that date to assign a Carrier.
  • Cancellation During Window: Customer may cancel at any time before Dispatch without penalty. To protect prior work if not yet dispatched, NX, LLC may keep the listing active up to 3 additional days and will contact the Customer if a Carrier becomes available with the option to reinstate at the current market rate.
  • Estimated Timing: Pickup and delivery dates are estimates, not guarantees. Weather, road conditions, mechanical issues, and other customers’ delays can impact schedules. NX, LLC is not liable for consequential costs (lodging, rental cars, lost wages, etc.).
  • Dry-Run Fee: If the vehicle is not released/ready at the scheduled time, Customer may incur a $100 dry-run fee.

6) Vehicle Condition, Size/Weight & Loadability

  • Operability: Vehicles are presumed running unless clearly disclosed. Failure to disclose inoperability results in an automatic $150 fee.
  • Representation: Pricing assumes factory-standard size/weight. Customizations, modifications, lift kits, oversize tires, or misrepresentation may lead to: (i) cancellation with forfeited dispatch fees and/or (ii) additional Carrier charges (including a $100 dry-run fee if requested by the Carrier).

7) Pickup/Delivery, Door-to-Door & Access Limits

  • Door-to-Door Defined: Carrier will attempt pickup and delivery at the addresses provided. If physical, legal, or safety constraints prevent close access (narrow streets, low trees, HOA rules, weight limits, etc.), Customer agrees to meet at the nearest safe location.
  • Contacts Required: Customer must provide accurate contact info for both pickup and delivery and ensure an adult is present to release/accept the vehicle and sign documents.
  • Unattended Exchange: If Customer authorizes pickup/delivery without anyone present (e.g., “keys under mat”), NX, LLC cannot assist in any claim for loss or damage arising from that choice. Delays caused by unavailable contacts may incur storage/holding or redelivery fees.

8) Bills of Lading (BOL), Inspections & Claims

  • Mandatory Inspections: At pickup and delivery, the Customer (or representative) and Carrier must jointly inspect the vehicle exterior and document condition on the Bill of Lading (BOL).
  • Condition Evidence: A signed BOL is required to support claims. Photos/videos/witness statements alone are not accepted as replacement.
  • Claim Timing: Any new damage must be noted on the delivery BOL and reported to the Carrier (and to NX, LLC for assistance) within 3 business days. Signing the BOL at destination without damage notation is conclusive evidence of satisfactory delivery.
  • Assistance: NX, LLC may assist with claims but is not the insurer. NX, LLC may be unable to assist if BOL documentation is missing or incomplete.

9) Insurance & Risk Allocation

  • Carrier Cargo Insurance: While on land, vehicles are covered by the assigned Carrier’s cargo insurance only (limits/deductibles apply). NX, LLC is not responsible for Carrier deductibles or any loss not covered by the Carrier’s policy.
  • Personal Property: Carriers are not licensed to transport household goods. Insurance does not cover items inside the vehicle.
  • Freight Charges vs. Claims: Under 49 U.S.C. §10761 and applicable ICC rulings (including Administrative Ruling No. 128), freight charges cannot be withheld or delayed due to alleged loss or damage. Claims are handled separately.

10) Ports, Offshore & International (PR, HI, AK & others)

  • Service Type: Puerto Rico, Hawaii, and Alaska shipments are Door-to-Port only.
  • Nearby Port Pricing: If Customer is close to a port, quotes may present a lower port drop-off rate (typically $200–$300 less than residential pickup).
  • Common Ports: Jacksonville, Oakland, Seattle, Kent, and Long Beach (subject to change).
  • Vessel Terms/Insurance: Some ocean carriers provide minimal (“scratch & dent” ~$500) or no coverage; insurance may be an optional add-on. Customer is responsible for obtaining the vessel’s terms and inquiring about/purchasing insurance.
  • Fuel Rule: Ports commonly require fuel at or below ¼ tank; vehicles exceeding limits may be denied.
  • Port Handoffs: For inbound port deliveries, Customer typically pays the Carrier’s portion at pickup. Customer must follow any shipping line instructions provided by NX, LLC.

11) Role of NX, LLC; Release Only to Named Carrier

  • Broker Status: NX, LLC manages loads and arranges transportation but is not the motor Carrier.
  • Identity Check: Customer agrees to release the vehicle only to the Carrier named on the Dispatch notice. If the calling driver/Carrier name does not match, Customer must contact NX, LLC immediately before releasing the vehicle.
  • Documents on Request: Customer may request NX, LLC’s operating authority and the assigned Carrier’s insurance certificate at any time.

12) Payment Timing, Non-Payment & Billing Issues

  • Deposit at Dispatch: The deposit (NX, LLC service fee) is charged when a Carrier is assigned. Once charged, the deposit is non-refundable.
  • Balance Due: For C.O.D. orders, the balance is due at delivery in certified funds to the Carrier.
  • Card Problems/Unreachable: If a Carrier is assigned and Customer cannot be reached or a card is invalid/missing/declined, NX, LLC may still dispatch to preserve scheduling. If the deposit must be collected at delivery, a $150 processing fee applies.
  • Collect at Pickup: If the payor will not be at delivery, payment may be required at pickup.
  • Storage & Holds: If balance is unavailable at delivery, the Carrier may hold the vehicle and charge storage or other fees until paid.
  • Credit Card Exception: NX, LLC may, at its discretion, allow the full balance to be paid by credit card (convenience fee applies).

13) Cancellations, Refunds & Processing

  • Before Dispatch: Customer may cancel in writing (submit via website contact form with order number) with no penalty.
  • After Dispatch: The deposit is non-refundable and serves as a cancellation fee. Offshore bookings are deemed dispatched once a vessel booking number is issued.
  • If Full Fee Was Charged by Card: Upon cancellation after Dispatch, NX, LLC will refund any remaining balance in full and retain the deposit portion (convenience fee is refunded with the full fee).
  • Adjustments/Errors: Approved refunds post within 7–10 business days.

14) Double-Booking & Conflicting Contracts

Customer agrees not to double-book with any other carrier or broker for the same vehicle(s).

  • If Customer double-books and another carrier/company picks up the vehicle after NX, LLC has dispatched a Carrier, it is treated as a cancellation “after carrier assigned,” and the deposit is non-refundable per Section 13.
  • This Agreement supersedes any other transport agreement made before or after execution of this Agreement.

15) Dealers—Authority & Liability

  • Dealer represents and warrants they are authorized to ship on behalf of the dealership.
  • Liability for unpaid invoices extends to both the signing Customer and the dealership as the Dealer’s principal.

16) Prohibited Items (Inside Vehicle)

Strictly prohibited: firearms, ammunition, explosives, flammables, alcohol, drugs or contraband, cash, jewelry, furs, high-value electronics, plants, and pets. Neither Carrier nor insurance covers personal property.


17) Governing Law & Venue

This Agreement is governed by the laws of the State of Florida. Any legal action arising from or relating to this Agreement must be filed in Miami-Dade court, and the parties consent to personal jurisdiction and venue there.


18) Defense, Indemnity & Hold Harmless

Customer shall defend, indemnify, and hold harmless NX, LLC from any and all actual or alleged causes of action, claims, demands, losses, damages, liabilities, and/or injuries (to property or persons, including without limitation wrongful death), whether brought by an individual or entity, arising out of or connected with any incident; any acts, omissions, negligence, or willful misconduct of NX, LLC or the assigned Carrier; or the actions of their respective personnel, employees, agents, or contractors in connection with or arising out of the services under this Agreement. This indemnification includes, without limitation, fines, penalties, judgments, awards, attorneys’ fees, related costs or expenses, and any reimbursements of any kind.


19) Severability, Entire Agreement & Modifications

  • If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
  • This document constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior proposals or agreements.
  • No modification is valid unless in writing and signed by Customer and an officer of NX, LLC.

20) Customer Acknowledgment

By placing an order, Customer represents that they are the legal owner of the vehicle(s) or duly authorized by the owner(s) to enter this Agreement and authorizes NX, LLC to arrange and dispatch a Carrier to transport the vehicle(s) identified in the order.
